Memory Experts International ("MXI") warrants to the Purchaser that its products are free from defects in material and workmanship under normal use for the time period indicated below. [Note: if the product you have purchased from MXI does not comply or function as specified with this warranty during the warranty period, please call MXI at: 888-422-6726, or 514-333-5010 (or in Europe at +44-208-758-9600) to obtain a Return Authorization number and instructions for return. Or, you can follow the Request for Return procedure on our website: www.canram.com.
The purchaser will be responsible for shipping charges [unless your return shipping address is within the US or Canada]. Subject to the conditions and limitations set forth below, MXI will at its option, either repair or replace any part of its product(s) that prove defective by reason of improper workmanship or materials. Repaired parts or replacement products will be provided by MXI on an exchange basis, and will be either new or refurbished to be functionally equivalent to new. This warranty does not cover (i) items normally consumed during product operation or (ii) any failure or damage that results from non-MXI products, accident, abuse, misuse, natural or personal disaster, or any unauthorized disassembly, repair, or modification.
Duration of Warranty
Lifetime Warranty: The following MXI products are covered by this warranty for life: 72PIN SIMM, 168PIN DIMM, and 144PIN SODIMM memory modules; EDO & Fast Page DRAM memory expansion boards, SDRAM memory expansion boards, DDR memory expansion boards, or Rambus-based memory modules and memory expansion boards.
One-Year Warranty: The following MXI products are covered by this warranty for a period of one year from the date of original retail purchase: hard drive subsystems; SmartMedia, Flash memory cards (e.g. CompactFlash and ATA Flash); solid state PC Card (PCMCIA) adapters, and all other MXI products (other than those listed under lifetime warranty periods).
This warranty covers only repair or replacement of defective MXI products, as provided above. MXI is not liable for, and does not cover under warranty, any costs associated with servicing and/or the installation of MXI products. MXI will not discontinue support of its products, nor obsolete its products, as long as there are component materials available in the marketplace and reasonable customer demand for the products.

THESE WARRANTIES AND LIMITATIONS ARE YOUR EXCLUSIVE WARRANTIES AND SOLE REMEDIES AND REPLACE ALL OTHER WARRANTIES, REPRESENTATIONS OR CONDITIONS, WHETHER EXPRESS OR IMPLED, INCLUDING BUT NOT LIMITED TO, TO THE EXTENT PERMITTED BY APPLICABLE LAW, IMPLIED WARRANTIES, REPRESENTATIONS OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
IN NO EVENT WILL MXI BE LIABLE TO YOU OR TO THE USER OF A MXI PRODUCT FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR ANY EXPENSES, LOST REVENUES, LOST SAVINGS, LOST PROFITS, LOST GOODWILL, OR ANY OTHER FORMS OF ECONOMIC LOSS, EVEN IF MXI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MXI'S LIABILITY EXCEED THE PRICE PAID FOR THE APPLICABLE MXI PRODUCT, REGARDLESS OF THE CAUSE AND WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.
MXI PROVIDES THIRD PARTY ITEMS ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND. [However, such third party items may carry their own warranties and MXI will pass through to you any such warranties to the extent authorized.]
Consumers
If this product is purchased by a consumer and not in the course of a business, this warranty shall not affect your statutory rights as a consumer.

Throughout its existence, MXI has placed extreme importance on reliability. MXI modules are designed to meet the specific requirements of the system or class of systems into which the module will be installed. Our memory is 100% tested to be reliable and compatible, and every effort is made to ensure that our products meet all fit, form, and function needs to be fully compatible in the host machine for which they were designed.
