Memory Experts International warrants to the Purchaser that its products are free from defects in material and workmanship under normal use for the time period indicated below. [Note: if the product you have purchased from Memory Experts does not comply or function as specified with this warranty during the warranty period, please call Memory Experts at: 888-422-6726, or 514-333-5010 (or in Europe at +44-208-758-9600) to obtain a Return Authorization number and instructions for return. Or, you can follow the Request for Return procedure on our website: www.canram.com.

The purchaser will be responsible for shipping charges [unless your return shipping address is within the US or Canada]. Subject to the conditions and limitations set forth below, Memory Experts will at its option, either repair or replace any part of its product(s) that prove defective by reason of improper workmanship or materials. Repaired parts or replacement products will be provided by Memory Experts on an exchange basis, and will be either new or refurbished to be functionally equivalent to new. This warranty does not cover (i) items normally consumed during product operation or (ii) any failure or damage that results from non-Memory Experts products, accident, abuse, misuse, natural or personal disaster, or any unauthorized disassembly, repair, or modification.

Duration of Warranty
Lifetime Warranty: The following Memory Experts products are covered by this warranty for life: 72PIN SIMM, 168PIN DIMM, and 144PIN SODIMM memory modules; EDO & Fast Page DRAM memory expansion boards, SDRAM memory expansion boards, DDR memory expansion boards, or Rambus-based memory modules and memory expansion boards.

One-Year Warranty: The following Memory Experts products are covered by this warranty for a period of one year from the date of original retail purchase: hard drive subsystems; SmartMedia, Flash memory cards (e.g. CompactFlash and ATA Flash); solid state PC Card (PCMCIA) adapters, and all other Memory Experts products (other than those listed under lifetime warranty periods).
This warranty covers only repair or replacement of defective Memory Experts products, as provided above. Memory Experts is not liable for, and does not cover under warranty, any costs associated with servicing and/or the installation of Memory Experts products. Memory Experts will not discontinue support of its products, nor obsolete its products, as long as there are component materials available in the marketplace and reasonable customer demand for the products.

THESE WARRANTIES AND LIMITATIONS ARE YOUR EXCLUSIVE WARRANTIES AND SOLE REMEDIES AND REPLACE ALL OTHER WARRANTIES, REPRESENTATIONS OR CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, TO THE EXTENT PERMITTED BY APPLICABLE LAW, IMPLIED WARRANTIES, REPRESENTATIONS OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

IN NO EVENT WILL MEMORY EXPERTS BE LIABLE TO YOU OR TO THE USER OF A MEMORY EXPERTS PRODUCT FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR ANY EXPENSES, LOST REVENUES, LOST SAVINGS, LOST PROFITS, LOST GOODWILL, OR ANY OTHER FORMS OF ECONOMIC LOSS, EVEN IF MEMORY EXPERTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MEMORY EXPERTS' LIABILITY EXCEED THE PRICE PAID FOR THE APPLICABLE MEMORY EXPERTS PRODUCT, REGARDLESS OF THE CAUSE AND WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.
MEMORY EXPERTS PROVIDES THIRD PARTY ITEMS ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND. [However, such third party items may carry their own warranties and Memory Experts will pass through to you any such warranties to the extent authorized.]

Consumers
If this product is purchased by a consumer and not in the course of a business, this warranty shall not affect your statutory rights as a consumer.
